DURING – What happens at the hearing?

During the hearing

In most hearings, there will be 3 members (decision-makers) at the Mental Health Review Tribunal (Tribunal) hearing. This includes:

  • a legal member
  • a medical member
  • a community member.

The members will read the clinical report and any other important information.

They will read your Self-Report if you have provided one and any other information you provide.

The members will give you a chance to have your say about your views on the order.

After hearing what you think and hearing from your treating team, the members will take some time to make their decision.

These are some of the most frequently asked questions.

What is the role of my representative?

The representative is there to speak on your behalf. They will represent your views, wishes and preferences. If you can’t express your views, wishes or preferences, they will represent your best interest.

What is the role of my support person during the hearing?

The support person is only there to sit with you and provide you support. They can also help you to remember what happened during the hearing and to understand the decision that the Tribunal made. This is different to the role of a representative.

If you don’t attend your hearing, your support person will also not be able to attend.
