DURING – What happens at a hearing?

During a hearing

In most hearings, there will be 3 members (decision-makers) at the Mental Health Review Tribunal (Tribunal) hearing. This includes:

  • a legal member
  • a medical member
  • a community member.

The panel will electronically audio record your hearing.

The members will already have read the clinical report and any other documents that were provided before the hearing.

They will read your Self-Report if you have provided one and any other information you provide.

The members will give you a chance to have your say about your views on the order. They may also ask you some questions. The members may also have questions for your treating team.

After hearing what you think and hearing from your treating team, the members will take some time to make their decision.

What is the role of my representative?

Your representative is there to speak on your behalf. They will represent your views, wishes and preferences. If you can’t express your views, wishes or preferences, they will represent your best interests.

What is the role of my support person during the hearing?

Your support person is only there to sit with you and provide you support. They can also help you to remember what happened during the hearing and to understand the decision that the Tribunal made. This is different to the role of a representative.

If you don’t attend your hearing, your support person will also not be able to attend.
