AFTER - What are my options?

After the hearing

In most cases the Mental Health Review Tribunal’s (Tribunal) will tell you the decision at the end of the hearing. You will also receive a written Notice of Decision in the post that gives you the Tribunal’s decision. This notice will give you information on what further options you can take regarding the decision made.

What are my options with regards to the Tribunal decision?

Talk to your treating team about your views on the decision.

Your family member, carer, or support person may also help you speak to the treating team if you want.

Request a statement of reasons from the Tribunal

To find out why the Tribunal made the decision, you or your nominated support person can ask for a statement of reasons by emailing MHRT.SOR@mhrt.qld.gov.au. In the email, list your full name and the date of your hearing.

Apply for a new hearing/review

You can apply to have your next hearing before the scheduled date.

To make the application, you must complete an Application for an Applicant Review Form and send it to the Tribunal.

Request a copy of the audio record of hearing

To make this request, complete the Request for record of hearing form.

What if I don’t agree with the Tribunal decision?  

Appeal

If you don’t agree with the decision made by the Tribunal, you can appeal to the Mental Health Court. For more information on the appeals process, please click here.
